Veeam is committed to protecting and respecting your privacy as well as being clear and transparent about how it collects and uses that data and to meeting its data protection obligations.

This Recruiting Privacy Notice covers the following issues in connection with our recruitment and hiring processes:

Please read this Notice carefully to understand our views and practices regarding your personal data and how Veeam will treat it. Note that if you interact with Veeam in ways that are outside the traditional recruitment and hiring process – e.g., if you visit Veeam’s website to request product materials or download software – any personal information we collect from you will be subject to the Veeam Privacy Notice.

Who Are We?

Veeam is a global leader in data management and data protection solutions across the globe, offering a variety of data backup and replication software products. We operate in over 160 countries and have offices in over 35 countries worldwide.

Under the General Data Protection Regulation (“GDPR”), Veeam Software Group GmbH is the “data controller” for Personal Information collected that is subject to this Privacy Notice. The address is:

Scope of This Notice

This Notice applies to Personal Information (as defined below) that we may collect through the process of recruiting and hiring individuals to work at Veeam (including for all of its affiliated entities).

Collection and Use of Personal Information

Personal Information (“Personal Information” or “Personal Data”) refers to information that can be used to identify, either directly or indirectly, an individual to whom the information applies. As used in this Recruiting Privacy Notice, Personal Information has the same meaning as “personal information,” “personal data,” “personally identifiable information,” or any similar term referenced in applicable law. 

During the recruitment process, Veeam will collect and process personal data relating to job applicants. Veeam collects this information in a variety of ways during the application and recruitment process. For example:

  • Through public sources;
  • Via personnel consultants or recruiters;
  • From you when you provide your personal data to us (e.g., by sending your résumé via email); or
  • By taking notes during your job interview.

In some cases, Veeam may collect personal data about you from third parties, such as references supplied by former employers, information from employment background check providers and information from criminal records checks permitted by law. 

Purposes. Veeam needs to process data prior to entering into a contract with you. We also need to process data to enter into an employment contract with you and to meet our obligations under that employment contract. In particular, Veeam collects and processes a range of Personal Information set out in the following section below for the following purposes:

  • To approach potential employees actively through different means as well as through commissioned personnel consultants (recruitment);
  • To plan and manage human resources on a global level, including but not limited to ensuring appropriate levels of staffing;
  • For investment decisions;
  • For planning and administration with respect to potential employee skills;
  • To process applications received via different communication methods (e.g., via email or LinkedIn);
  • To organize the application process;
  • For the establishment, exercise or defence of legal claims; and
  • To be able to consider applicants to one or more jobs for other job opportunities.

Lawful Bases. We process the categories of your personal data listed above on the basis of our overriding legitimate interest according to Article 6(1)(f) General Data Protection Regulation (“GDPR”), which is to guarantee an efficient application process and to ensure that we fill our vacancies with suitable job applicants.

Veeam processes health information if we need to make reasonable adjustments to the recruitment process for candidates with a disability. 

In a separate process, we may ask you to consent to us keeping your personal data for the purpose of contacting you regarding future vacancies and/or to receive marketing communications (Article 6(1)(a) GDPR).

Potential Consequences. You are under no obligation to provide Veeam with data during the recruitment process. However, if you do not prove certain information when requested, Veeam may not be able to process your application for employment properly or at all. You are under no obligation to provide information for equal opportunities monitoring purposes and there are no consequences for you if this information is not provided. Should the provision of your personal data be mandatory by law, we will inform you separately thereof.

Automated decision-making. Our employment decisions are not based solely on automated decision-making.

Data Retention. Veeam will retain your personal data at least for the duration of the application process. If you consent to us holding on to your application for consideration with respect to future employment opportunities, we will retain the application at least until you withdraw your consent.

In all cases, we will retain your data for as long as required to fulfil any statutory or other legal obligations we may have, including with respect to potential legal claims where personal data is needed to raise or defend against the claim.

If your application for employment is successful, your personal data gathered during the recruitment process will be transferred to your personnel file and will be subject to an employee data privacy notice that we will provide to you at that time.

Disclosure to Third Parties, Service Providers, and Others

To achieve the purposes set out above, we will transfer your personal data to the following categories of recipients:

  • IT and other service providers that we use.

Some of the recipients in the categories referenced above are located in or process personal data outside of your country. The level of data protection in another country may not be equivalent to that in your country. However, we only transfer your personal data to countries where the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients provide an adequate level of data protection. We do this, e.g., by entering into appropriate data transfer agreements based on Standard Contractual Clauses (2010/87/EC and/or 2004/915/EC).

Cookies

Depending on how you interact with Veeam, you may come across a Veeam websites, advertisement, email, or other online services. These often use certain automatic data collection technologies, such as cookies, web beacons, and pixel tags, to collect data, including Personal Information. This data helps us to understand our users’ behavior, web searches, and where on our websites users have visited. We use cookies to distinguish among different users of our website, to help us provide you with a good experience when you browse our website, and to allow us to improve our website.

Your Data Privacy Rights

Generally

Veeam is a global company, and we collect personal information from individuals all over the world. We strive to comply with all applicable privacy and data security laws around the globe, including GDPR, the California Consumer Privacy Act (“CCPA”), and other applicable laws. To that end, we offer a number of tools to help maximize your control over the information Veeam may have about you.

If you have given your consent for Veeam to store your Personal Information to receive marketing communications from Veeam, you can manage what information you receive from Veeam about products and services and how such information is received by specifying your communication preferences and subscription details at the subscription preferences page.

If you provided consent, but later wish to discontinue receiving marketing and/or non-transactional e-mails from us, you may do so in the “My Account” section of our website or using an "unsubscribe" link in any email or the Veeam unsubscribe pageNote that this does not apply to transactional emails related to users’ business relationship with Veeam.

If you have given your consent for Veeam to store your Personal Information for future job opportunities from Veeam and wish to revoke that consent, please email privacy@veeam.com with your name and a statement that you wish to revoke your consent for consideration for future job opportunities.

In the event you choose not to provide certain Personal Information, we may not be able to review your application, respond completely or adequately to your questions, provide updates, and/or information about the position(s) for which you have applied or our products and services. We will however continue to use your Personal Information for the limited purpose of sending you important notices relating to information about your purchases, changes to our policies and agreements, or for other reasons permitted by applicable law.

Your GDPR and California Privacy Rights.

Where GDPR and CCPA applies to the Personal Information we have collected, you may have certain rights you can exercise under certain circumstances. These may include:

  • Right of Access/Right to Know/Right to Data Portability: You have the right to request that Veeam disclose to you the Personal Information we collect, use, or share about you, as well as information about our data privacy practices.
  • Right of Erasure/Deletion: You may have the right to request that we delete the Personal Information that we have collected from you or about you.
  • Right to Object: You may have the right to object to, or opt-out of, certain processing Veeam undertakes with your Personal Information.
  • Right to Rectification: You may have the right to correct any incomplete or inaccurate Personal Information Veeam may hold about you.
  • Right to Non-Discrimination: Veeam will not discriminate against you for exercising any of these rights.
  • Right to Lodge a Complaint: Under GDPR to lodge a complaint with an appropriate data protection authority if you have concerns about how we process your Personal Information.

Veeam does not “sell” your Personal Information.

Some of these rights can be exercised at the subscription preferences page. For example, you can correct certain of the Personal Information we have about you, you can withdraw consent for or object to certain processing, and you can restrict certain processing.

Note that to protect the security, confidentiality, and integrity of your Personal Information, we may need to verify your identity before processing your request. In some cases we may need to collect additional information to verify your identity, such as a government issued ID.

Finally, under the CCPA you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. If you choose to do that, we may seek additional information to ensure that you have actually designated the agent to make the request.

Data Security

Veeam takes the security of Personal Information seriously. To protect Personal Information against accidental or unlawful destruction, loss or alteration, Veeam uses risk-based technical and organizational security measures reasonably designed to prevent any unauthorized disclosure or access. For example, Veeam has implemented strict security controls, intrusion detection software and processes to alert us in the case of a potential or actual intrusion of our information systems.

Storing and Transferring Personal Information

Veeam is a global organization so the information you provide to Veeam may be transferred or accessed by Veeam corporate entities in Switzerland and other countries around the world. No matter where Veeam stores or accesses Personal Information, it is collected, used, shared, and protected in accordance with this Privacy Notice.

Veeam uses approved Standard Contractual Clauses for the transfer of Personal Information collected in the European Economic Area and Switzerland to third countries.

Veeam also abides by the Asia-Pacific Economic Cooperation (APEC) Cross Border Privacy Rules System. The APEC CBPR system provides a framework for organizations to ensure protection of Personal Information transferred among participating APEC economies. 

Children’s Privacy

Veeam will not knowingly collect Personal Information from any person that is not a legal adult, as defined by local law, without insisting that they seek prior parental consent, if such consent is required by applicable law. In the event Veeam uses or discloses Personal Information of a person that is not a legal adult, Veeam will seek parental consent pursuant to local laws and regulations in order to protect the person that is not a legal adult.

Changes to this Recruiting Privacy Notice

As a technology company, our systems will mature and change as will this Recruiting Privacy Notice. Changes to this Recruiting Privacy Notice with the most recent revision date will be posted at www.veeam.com. We will take steps to notify you of the material changes to this Recruiting Privacy Notice by posting the changes here or contacting you by e-mail.
