Veeam Private Preview Terms

Last updated: October 15, 2026

These Veeam Private Preview Terms (the “Terms”) apply to any feature, product, service, or software that Veeam makes available before general availability and identifies as beta, preview, private preview, early access, technical preview, or similar (the “Preview”).

By clicking to accept these Terms, or by accessing or using the Preview, you agree to these Terms on behalf of the entity you represent (“Customer” or “you”) and confirm that you are authorized to do so. If you do not agree, do not use the Preview.

1. Use of Previews

1.1 Veeam grants you a limited, non-exclusive, non-transferable, revocable right to use the Preview, for as long as Veeam makes it available to you, solely for internal testing and evaluation and to give Veeam feedback.

1.2 You may not make the Preview available to any third party, use it to provide services to others, or reverse engineer, decompile, or disassemble it, except to the extent applicable law expressly permits this.

1.3 If the Preview works with a Veeam product or service you already use, your agreement for that product or service continues to govern it. These Terms govern the Preview only.

2. Nature of Previews

2.1 Previews are pre-release. They may not work correctly, may contain errors or security vulnerabilities, may be changed, suspended, or discontinued at any time without notice, and may never become generally available.

2.2 Previews are not intended for production use. If you use the Preview with production systems or data, you do so at your own risk. The Preview is not a substitute for, alternative to, or supplement to generally available services and software provided by Veeam.

2.3 Previews are not covered by any service level, support, warranty, or indemnity commitment.

3. Data

3.1 The Preview may collect or process data from your systems. Veeam uses that data to provide support, secure the Preview, and improve the Preview to prepare it for general availability.

3.2 To the extent that data includes personal data, the Veeam Data Processing Addendum available at https://www.veeam.com/legal/data-processing-addendum.html (the “DPA”) applies to its processing and is incorporated into these Terms by reference.

3.3 To the extent that data includes Protected Health Information, as defined under the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations (“HIPAA”), and Veeam qualifies as your Business Associate, the Veeam Business Associate Addendum available at https://www.veeam.com/legal/veeam-business-associate-agreement.html (the “BAA”) applies and is incorporated into these Terms by reference, solely to the extent required by HIPAA.

3.4 Veeam may collect data, including technical data, diagnostics, feedback, and usage information about the Preview to maintain, improve, and develop its products and services. Data, when used this way, will not include backup content, Personal Data, your confidential data, or data identifying you as a customer.

4. Feedback

4.1 Veeam may use any feedback, ideas, or suggestions you provide about the Preview for any purpose, without restriction or payment.

5. Confidentiality

5.1 Until Veeam makes the Preview public, the Preview and all non-public information about it, including its features, documentation, and any performance, benchmark, or test results, are Veeam’s confidential information.

5.2 You will not publish or disclose to any third party any benchmark, performance, or comparative test results for the Preview without Veeam’s prior written consent.

5.3 You will promptly notify Veeam of any unauthorized use or disclosure of Veeam’s confidential information you become aware of.

5.4 A breach of this Section 5 may cause Veeam irreparable harm for which damages would not be an adequate remedy. Veeam may seek injunctive or other equitable relief, without posting a bond, in addition to any other remedies.

6. Disclaimer and limitation of liability

6.1 PREVIEWS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VEEAM OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO THE PREVIEW OR THESE TERMS, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, DAMAGE TO SYSTEMS OR BUSINESS INTERRUPTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

7. Term and termination

7.1 Your right to use the Preview ends when Veeam ends the Preview or makes it generally available, or earlier if either party ends your participation.

7.2 The Preview does not convert into a paid or generally available product or service. Use of any generally available version requires a separate purchase and is subject to Veeam’s standard terms.

7.3 Sections 3 to 6 and 8 survive the end of your use of the Preview.

8. General

8.1 Veeam entity and governing law. Previews of Veeam Data Cloud and other Veeam cloud services are provided by Veeam VaaS Corporation, and these Terms are governed by the laws of the State of New York, with exclusive jurisdiction in the federal or state courts located in New York County, New York. All other Previews are provided by Veeam Software Group GmbH, and these Terms are governed by the laws of Switzerland, with exclusive jurisdiction in the courts of the Canton of Zug. In each case, conflict-of-law rules and the U.N. Convention on Contracts for the International Sale of Goods do not apply. “Veeam” means the applicable entity.

8.2 Export. Section 12 (Export Control) of the Veeam End User License Agreement at https://www.veeam.com/legal/eula.html applies to Previews.

8.3 Changes. Veeam may update these Terms by posting a new version at this page. Changes apply to Previews you start using after the update.

8.4 Entire agreement. These Terms, together with the DPA and the BAA, where applicable, constitute the entire agreement between you and Veeam regarding Previews. If you and Veeam have signed a separate agreement for a specific Preview, that agreement prevails for that Preview. If any provision is unenforceable, the rest remains in effect.
